This End User License Agreement (this "Agreement") is a legally binding agreement between you (the "User" or "You") and OKOK regarding your use of the OKOK health measurement products or related services. It constitutes the final, complete, and exclusive agreement between you and OKOK concerning the subject matter herein. This Agreement legally governs your use of OKOK related applications or services. Therefore, please read all terms of this Agreement carefully (minors should read accompanied by a guardian), including disclaimers limiting or excluding OKOK's liability, terms restricting your rights, and clauses specifying dispute resolution, jurisdiction, and governing law. If you do not accept all terms of this Agreement, do not install, copy, or use OKOK related products or services. By clicking the "Agree" button during registration, you indicate your full acceptance of all terms under this Agreement and any subsequent revisions OKOK may make. Your decision to access or use OKOK services signifies your agreement to be bound by all terms of this Agreement.
I. Rights Statement
OKOK owns the intellectual property rights of its products and services, protected by Chinese law. Any unauthorized modification, copying, distribution, dissemination, translation, reverse compilation, or reverse engineering of OKOK applications constitutes infringement, and OKOK reserves the right to pursue legal liability accordingly.
II. Services Provided by "OKOK"
1. OKOK related health product applications provide services or functions including but not limited to: fitness, wellness, pregnancy guides, and baby development reference guides, etc. (the "Services"). Unless otherwise specified, any new features, services, or products added to enhance or strengthen the current services unconditionally adhere to these service terms.
1.1. Using OKOK applications to browse or view related health information will generate corresponding data charges collected by your carrier, with no other fees incurred.
1.2. OKOK applications provide a favorites synchronization function. To ensure the security of user data, OKOK will implement strict security measures for user data servers.
1.3. OKOK applications provide an update reminder function, which requires accessing the names and version numbers of software applications installed on your phone to compare them on the server, in order to notify you of available application updates.
2. OKOK does not guarantee that the services will meet your requirements, nor that the services will be uninterrupted, and makes no warranties regarding the timeliness, security, or accuracy of the services.
3. OKOK reserves the right to charge fees for all or part of the services in the future.
III. Scope of License for Using "OKOK"
1. You may install, use, display, and run this application on a computer or other handheld terminal for non-commercial purposes. You may not install, use, or run this application for commercial purposes, nor may you copy, alter, modify, run, or create derivative works from the data released into any terminal memory during the operation of this application or the client-server interaction data, including but not limited to using plugins, add-ons, or unauthorized third-party tools/services to access this application and related systems.
2. Reserved Rights: All other rights not expressly granted herein remain with OKOK. You must obtain written permission from OKOK to exercise any other rights.
3. You may use this application in accordance with this Agreement, provided you comply with laws and this Agreement. You must not engage in the following (including but not limited to):
3.1. Remove all copyright information from this application and its copies;
3.2. Reverse engineer this application, such as disassembling or decompiling;
3.3. Modify or damage the original state of this application;
3.4. Engage in any activities that harm network security, including but not limited to: unauthorized probing, scanning, or testing of system or network vulnerabilities; interfering with or disrupting the normal operation of the application or website; intentionally spreading malicious programs or viruses; forging TCP/IP packet names or parts of names;
3.5. Using OKOK applications and services through third-party compatible software/systems not developed, authorized, or approved by OKOK; using plugins/add-ons for OKOK software and services not developed, authorized, or certified by OKOK;
3.6. Without OKOK's written consent, performing any actions including but not limited to: using, copying, modifying, linking, reprinting, compiling, publishing, establishing mirror sites, developing derivative products/services/plugins/add-ons based on this application;
3.7. Using this application to publish, transmit, disseminate, or store content that violates national laws, endangers national security, promotes separatism, disrupts social stability, or is inappropriate, defamatory, obscene, violent, or otherwise illegal;
3.8. Using this application to publish, transmit, disseminate, or store content that infringes on others' intellectual property rights, trade secrets, or other legal rights;
3.9. Using this application to bulk publish, transmit, or disseminate advertisements or spam;
3.10. Using images or information obtained through this application in a manner that infringes on trademarks, copyrights, patents, trade secrets, or other proprietary rights;
3.11. Modifying or forging instructions, data, or packets during the operation of the software, altering its functions or effects, or distributing such software to the public;
3.12. Using this application and OKOK services for nuclear facilities, life support, or other major equipment that could endanger human life or property. You acknowledge that the application and services are not designed for such purposes, and OKOK bears no responsibility for any failures resulting in personal injury, property damage, or environmental harm;
3.13. Without OKOK's explicit written permission, distributing, transferring, or sublicensing the software/services or related links, or profiting from their use, whether directly or indirectly;
3.14. Using this application and other OKOK services in any illegal manner, for any illegal purpose, or in any way inconsistent with this Agreement. If you violate these terms, OKOK has the right to terminate, suspend, or restrict your use of the application.
4. Use of this application must comply with national laws and policies, safeguard national interests and security, and adhere to this Agreement. You are solely responsible for any liabilities arising from illegal or non-compliant use, and OKOK and its partners bear no responsibility; if OKOK or its partners suffer losses, they have the right to claim compensation from you.
5. If you fail to comply with any term of this Agreement, OKOK has the right to terminate this Agreement immediately and cease providing the application and services, reserving the right to pursue legal action.
6. This application is freeware. You may download, install, copy, and distribute it for non-commercial purposes. Commercial sales, copying, or distribution (e.g., pre-installation or bundling) require written authorization from OKOK.
7. This application is freeware. Use is at your own risk. You must ensure you have the necessary conditions to run the application and the right to use the required operating system. To the fullest extent permitted by law, OKOK shall not be liable for any special, incidental, direct, or indirect damages arising from your use or inability to use the application, even if advised of the possibility of such damages.
IV. Rules for Using "OKOK"
Users are especially reminded that using the internet requires compliance with national policies and laws, such as the Criminal Law, National Security Law, Secrecy Law, Regulations on the Protection of Computer Information System Security, Intellectual Property Law, etc., to protect national interests and security. You are solely responsible for any liabilities arising from illegal internet use.
1. You must not use this application for activities that violate national legal systems.
2. Like most computer software, this application may encounter various security and usage issues. OKOK assumes no related responsibility, including but not limited to:
2.1. Other installed software containing viruses like "Trojan horses," threatening personal information and data security, and consequently the use of this application;
2.2. Encountering malicious web pages when browsing news source links, leading to device infection or damage;
2.3. Inability to download normally due to reasons attributable to the file provider, network, or the software/hardware you use.
3. Replacement, Modification, and Upgrade of the Application: OKOK reserves the right to provide replacement, modified, or upgraded versions of the application at any time and to charge fees for such changes. OKOK will prompt users about upgrades; users can also check for upgrades manually. OKOK does not guarantee the continued availability of old versions after a new version is released. OKOK reserves the right to unilaterally change or restrict part of the software's functions due to business needs, and you assume this risk.
4. Young people should use this application under the guidance of parents and teachers to learn how to use it correctly.
5. OKOK advises users to download and install the application through the official OKOK website or designated methods. Be cautious of downloading the application from non-designated websites to avoid infecting your device with malicious programs that can destroy data or obtain private information.
6. You may use the application and services to post comments or feedback that you have created or have the right to publish. You must ensure that you own the copyright to the uploaded content or have obtained legal authorization, and that your use of the application and services does not infringe upon any third party's legal rights.
7. You understand and agree that by using the application and services, you will abide by the rights and obligations in these terms. You are responsible for all actions performed under your registered account.
8. You understand and agree that OKOK cannot be held responsible for user behavior. You assume all risks associated with using the application and services. OKOK makes no warranties regarding the applicability, security, or harmlessness of the application and services. If you discover any illegal activities while using the application and services, you are obligated to report them to OKOK promptly.
9. You must not use the application and services to intentionally create or disseminate destructive programs like computer viruses, interfere with the services/servers/networks connected to the application, or violate any network requirements, procedures, policies, or rules. Otherwise, OKOK reserves the right to pursue legal action and refer the matter to relevant authorities.
10. You must not use the application and services to transmit, copy, send, upload, or publish any information that hinders social order, or is illegal, false, harassing, insulting, intimidating, harmful, destructive, provocative, or obscene.
11. The rights you obtain under this Agreement are non-transferable.
12. If you violate national laws or the terms of this Agreement, OKOK and its partners have the right to stop providing services to you without liability. If this causes any damages to OKOK or its partners or leads to any disputes/litigation/claims from third parties, you must compensate OKOK or its partners for the losses. You are fully legally responsible for all consequences of violating the terms. OKOK has the right to identify and delete any content that does not comply with laws, regulations, policies, or these terms without prior notice.
13. For any reason, OKOK may terminate any account (or part thereof) or suspend your use of the services.
14. You must adhere to, including but not limited to, the following prohibitions:
14.1. Using the application and services to disseminate content contrary to the principles established by the Constitution;
14.2. Using the application and services to disseminate content that endangers national security, leaks state secrets, subverts state power, or undermines national unity;
14.3. Using the application and services to disseminate content that damages national honor and interests;
14.4. Using the application and services to disseminate content that incites ethnic hatred/discrimination or undermines ethnic unity;
14.5. Using the application and services to disseminate content that violates state religious policies, promotes cults, or feudal superstitions;
14.6. Using the application and services to spread rumors, disrupt social order, or undermine social stability;
14.7. Using the application and services to disseminate obscene, pornographic, gambling, violent, murderous, terrorist, or criminally inciting content;
14.8. Using the application and services to disseminate content that insults or slanders others, infringing on their legal rights;
14.9. Using the application and services to disseminate other content prohibited by laws/regulations;
14.10. Using the application and services to upload viruses, trojans, worms, or other content harmful to network health;
14.11. Creating, publishing, or disseminating software designed to steal OKOK accounts, others' exclusive information, property, or confidential information;
14.12. Using the application and other OKOK services in any illegal manner, for any illegal purpose, or inconsistent with this Agreement;
15. OKOK has the right to place various advertisements and promotional information within the services, which may appear as system messages or pop-ups;
16. If you fail to comply with any of the above provisions, OKOK has the right to delete the relevant content or terminate, suspend, or stop your use of the application/services without prior notice; if this causes losses to OKOK, OKOK has the right to claim corresponding compensation, including but not limited to fines, compensation, and litigation/legal fees incurred by OKOK;
17. OKOK reserves the right, due to business development needs, to change, suspend, restrict, terminate, or revoke all or part of the "OKOK" services at any time without notice;
18. The services provided by "OKOK" may include advertisements. You agree to display advertisements provided by OKOK and/or third-party suppliers/partners during use.
19. Rights and Obligations regarding "OKOK" Accounts:
19.1. You understand that the "OKOK" application offers email registration/login, and the "News Info" application offers OKOK account login.
19.2. Ownership of both "OKOK" accounts and "News Info" accounts belongs to OKOK. After completing the registration process for the News Info application, users obtain the right to use the "News Info" account. This right belongs solely to the initial registrant and is prohibited from being gifted, borrowed, rented, transferred, or sold. OKOK has the right to reclaim "News Info" accounts for operational needs.
19.3. You have the right to change or delete your personal nickname, avatar, and transmitted content on the "OKOK" and "News Info" accounts. Note that deleting information will also remove any text and images stored in the system; please proceed with caution.
19.4. You are responsible for safeguarding your registered account information and password. You are legally responsible for all activities under your account and password. You agree not to use another member's account or password. If you suspect unauthorized use of your account or password, notify OKOK immediately.
19.5. You must comply with all terms of this Agreement and use the services correctly and appropriately. If you violate any term, OKOK has the right to terminate services for your "OKOK" and "News Info" accounts. OKOK also reserves the right to reclaim "OKOK" and "News Info" account usernames at any time.
19.6. If you do not log in to your "OKOK" or "News Info" account for an extended period (three months), OKOK has the right to recycle the account.
19.7. If a user of the OKOK application actively uses an "OKOK" account, or a user of the News Info application actively uses a "News Info" account to log in, it signifies the user's willingness to use OKOK's personalized services. You must not impersonate others; use another's name to send/receive/share information; or maliciously use registered accounts to cause misidentification. Otherwise, OKOK has the right to immediately stop services and reclaim the "News Info" account.
19.8. You are solely responsible for the authenticity, legality, harmlessness, and validity of the information on your "OKOK" and "News Info" accounts. You bear all legal liability related to the information you disseminate.
20. OKOK may, at its reasonable discretion, take appropriate legal action against any content that violates laws/regulations or this Agreement, or infringes, hinders, or threatens anyone's rights or safety, or involves impersonation, including but not limited to deleting illegal, infringing, or inappropriate content from the services, terminating the membership of violators, restricting their use of all or part of the services, preserving information as required by law, and reporting to relevant authorities.
V. Use and Restrictions of User Information and Privacy Protection
Respecting user privacy is a consistent policy of OKOK. OKOK will take reasonable measures to protect your personal privacy information.
The privacy statement applicable to users can be found in the attachment: "OKOK Privacy Protection Statement".
OKOK uses the HealthKit framework to share OKOK health data (e.g., height, weight, blood sugar, blood pressure) with the Health app. OKOK will not retrieve other data from the Health app. You can select OKOK from the health list to enable or disable sharing permissions. OKOK will take reasonable measures to ensure your Health data is never used for marketing or advertising purposes.
VI. Intellectual Property Statement of "OKOK"
Except for news content, the intellectual property rights of the content provided by OKOK in these services (including but not limited to web pages, text, images, audio, video, charts) belong to OKOK. The intellectual property rights of content generated by you during your use of the services belong to you or the relevant rights holders.
Unless otherwise stated, the copyrights, patent rights, and other intellectual property rights of the software underlying the services provided by OKOK belong to OKOK.
The "OKOK" and "News Info" logos, graphics, text, their combinations, and other OKOK logos and product/service names involved in the services are copyrighted or trademarked by OKOK.
The intellectual property rights mentioned above and any other content of the services are protected by law. Without the written permission of OKOK, the user, or the relevant rights holder, no one may use the content in any form or create derivative works, display or use OKOK logos in any way, or indicate that you have the right to display, use, or otherwise handle OKOK logos.
VII. Service Risks and Disclaimer
1. License to Utilize
1.1. License to Utilize Your Device: To benefit from the application, you grant OKOK a license to use your device's processor and bandwidth for purposes such as web browsing and video playback.
1.2. Protecting Your Device Resources: You acknowledge that the "OKOK" software will use commercially reasonable efforts to protect the privacy and integrity of your device resources and communications, but you agree that OKOK provides no warranty in this regard.
2. OKOK specifically reminds you that OKOK reserves the right to modify or interrupt services at any time without notice to ensure its autonomy in business development and adjustments. OKOK exercises this right without liability to you or any third party. OKOK only begins providing services after you agree to these terms.
3. If you violate this Agreement or related terms, causing any third-party claims, demands, or losses (including reasonable attorney fees), you agree to indemnify OKOK, its partners, and affiliated companies, and hold them harmless.
4. OKOK and its partners are not liable for any losses you suffer due to third-party reasons such as communication line failures, technical issues, network/terminal failures, system instability, or other force majeure events.
5. In the event of service disruption due to technical failures or other uncontrollable events, OKOK and its partners commit to cooperating with relevant parties to resolve the issue promptly, but assume no liability for any resulting losses.
6. Like most internet software, this application is susceptible to various security issues influenced by factors including user behavior, network quality, and social environment. Examples include harassment caused by others using your information; threats to your device's data security from viruses like "Trojans" in other downloaded software or visited websites, affecting the application's normal use. You should enhance awareness of information security and personal data protection, and strengthen password security to avoid losses or harassment.
7. Any software derived from this application not officially released by OKOK or authorized by OKOK is illegal. Downloading, installing, or using such software may lead to unforeseeable risks. OKOK is not responsible for any legal disputes arising therefrom.
8. You understand that using this application involves internet services and may be affected by unstable factors at various stages. Therefore, risks include service interruption or failure to meet requirements due to force majeure, computer viruses, hacker attacks, system instability, your location, device shutdown, or other technical/internet/communication line reasons. You assume these risks; OKOK provides no guarantees. OKOK is not liable for any resulting inability to send/receive information or incorrect transmission/reception.
9. You understand that using this application carries the risk of exposure to threatening, defamatory, offensive, or illegal content, or infringement of others' rights (including intellectual property), from anonymous or impersonating sources. You assume these risks. OKOK and its partners provide no warranties, express or implied, regarding the services, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. They are not liable for any direct, indirect, incidental, special, or consequential damages arising from improper or illegal use of the services.
10. When you use the application or request specific services from OKOK, the application may call third-party systems to support your use or access. The results provided by the third party are not guaranteed by OKOK regarding security, accuracy, effectiveness, or other uncertainties. OKOK is not responsible for any disputes or damages arising therefrom.
11. Information defined by OKOK includes: text, software, sound, photos, videos, graphics; all content in advertisements; commercial information provided by OKOK to users. All this content is protected by copyright, trademark, and other intellectual property laws. Therefore, you may only use this content with authorization from OKOK and advertisers, and may not copy, modify, edit, or create derivative works without permission.
12. When using the application and services, you assume the following risks, including but not limited to those beyond OKOK's control:
12.1. Loss or leakage of personal information like contacts or messages due to uncontrollable factors;
12.2. You must select an "OKOK" software version compatible with your device. Otherwise, any issues or damage due to incompatibility are your responsibility.
12.3. Information security risks related to your device's private data when using the application and services.
12.4. You assume all risks regarding content quality and security when accessing third-party websites through the application.
13. OKOK specifically reminds:
13.1. Use of the application must comply with national laws and policies, safeguard national interests and security, and adhere to this Agreement. You are solely responsible for any liabilities from illegal or non-compliant use; OKOK and its partners bear no responsibility. If losses occur, they have the right to claim compensation and retain relevant records. Furthermore, for violations of this Agreement or the terms of other services accessed via OKOK accounts, OKOK may, at its discretion and without prior notice, take measures including license revocation, service termination, usage restriction, account recovery, and legal action.
13.2. Any software derived from this application not officially released or authorized by OKOK is illegal. Downloading, installing, or using such software may lead to unforeseeable risks. OKOK is not responsible for resulting legal disputes. Users should avoid downloading, installing, or using such software.
13.3. You understand that OKOK may provide your personal information as required by law or government authorities. OKOK assumes no liability for any resulting legal consequences.
13.4. You understand that OKOK is not liable for risks incurred from threatening, defamatory, offensive, or illegal information disseminated anonymously or under false pretenses via "OKOK".
13.5. You understand that OKOK is not liable for any psychological, physical, or economic losses resulting from interactions with other users through "OKOK" due to deception or misinformation.
13.6. "OKOK" expressly states that it makes no warranties, express or implied, regarding the timeliness, security, or accuracy of its services or those of its partners.
13.7. If you violate this Agreement or related terms, causing any third-party claims, demands, or losses (including reasonable attorney fees), you agree to indemnify OKOK, its partners, and affiliated companies, and hold them harmless.
VIII. Other Terms
1. OKOK emphatically reminds you to pay attention to the terms in this Agreement that exempt OKOK from liability and increase your obligations. Please read carefully and assess the risks independently. Minors should read this Agreement accompanied by a legal guardian.
2. If any term or part thereof is invalid, it does not affect the validity of the remaining terms.
3. This Agreement is concluded in Shenzhen. The interpretation, validity, and dispute resolution of this Agreement are governed by the laws of the People's Republic of China. Any disputes between you and OKOK shall first be resolved through friendly negotiation. If negotiation fails, you hereby agree to submit the dispute to the Shenzhen Arbitration Commission for jurisdiction.
4. The headings in this Agreement are for convenience only and have no substantive meaning; they cannot be used as a basis for interpreting the Agreement.
